OFF-ROAD USE ONLY: Pacenote is designed strictly for use on closed courses, private tracks, and designated off-road areas. It is NOT intended for use on public roads.

BY USING THIS APP, YOU AGREE THAT YOU ARE ENGAGING IN A POTENTIALLY DANGEROUS ACTIVITY. THE DEVELOPERS OF PACENOTE ACCEPT NO RESPONSIBILITY OR LIABILITY FOR ANY INJURY, DISABILITY, OR DEATH RESULTING FROM THE USE OF THIS APPLICATION.

1. Assumption of Risk

You expressly acknowledge and agree that rally-style driving and navigating at speed involve inherent risks of serious bodily injury and death. You use Pacenote at your own sole risk. The app is a supplemental tool and should never override your own judgment or the physical reality of the terrain.

2. Public Road Use & Speeding

We do not recommend or condone the use of Pacenote on public highways or streets. Any use of the app that involves exceeding posted speed limits or violating local traffic laws is strictly prohibited and is done so entirely at the user's legal and physical risk.

3. Location Data & Permissions

To provide real-time co-driver directions, Pacenote requires:

Precise Location (GPS): To calculate distance to corners.
Background Location: To maintain functionality if the screen dims or during multi-tasking.
Foreground Services: To ensure uninterrupted delivery of pacenotes during high-speed movement.

4. Limitation of Liability

Under no circumstances shall the creators of Pacenote be liable for:

Personal injury or wrongful death.
Property damage or vehicular loss.
Fines, tickets, or legal penalties.
Inaccuracies in map data or generated pacenotes.

5. Indemnification

You agree to indemnify and hold harmless Pacenote and its developers from any claims, losses, or expenses (including legal fees) arising from your use of the app, your violation of these terms, or your operation of a motor vehicle.

By tapping "Accept" or using the Pacenote app, you confirm you have read these terms and voluntarily assume all risks associated with its use.
